TERMS & CONDITIONS FOR ‘Cricket Magic with More and Pure Magic’ CONTEST

1. Definitions
   1. Customer(s): Any person who purchases a packet of Britannia Chocolush Biscuit from More Hyper Market stores or MRPL online platform operating at Bangalore, Lucknow, Kolkata, Hyderabad, Delhi.
   2. Participant(s): Any Customer who provides his/her legal name and Whatsapp number to MRPL after purchasing a packet of Britannia Chocolush Biscuit 300 gms and thereafter answers the qualitative question as per the below mentioned Terms and Conditions.
   3. Winner(s): As defined in clause 7 of this Terms and Conditions.
   4. Britannia Chocolush Biscuit: shall mean Britannia Pure Magic Chocolush Biscuit 300 gms 

Agreement to Terms and Conditions 

The “Cricket Magic with More and Pure Magic Contest” is a consumer contest (“Contest”) sponsored and organized by the More Retail Private Limited (“MRPL”) and Britannia Industries Ltd jointly. (“Britannia”).

Any Customer participating or seeking to participate in the Contest shall individually be referred to as “Participant” and collectively be referred as “Participants”.

(i) These terms and conditions apply to the Contest and aspects thereof (“Terms & Conditions”).

(ii) By participating in the Contest, the Participants fully and unconditionally agree to and accept these Terms and Conditions which are available on Britannia.co.in/campaigns-pure-magic-t-and-c (“Contest Website”). The decisions of Britannia/MRPL will be final and binding in all matters related to the Contest. Successfully entering the Contest and winning a prize is subject to all requirements set forth herein.  

 (ix) The Contest is subject to all applicable central, state and local laws and regulations.

(xii) No request of re-scheduling the dates or extension of the prize or replacement of the prize shall be entertained by MRPL/Britannia.

1. Eligibility

(i) This Contest will be open to every Indian citizen aged 18 or above residing in India, provided that the Participant is not facing any criminal/civil trial or any other legal proceedings which may hamper the contest in any other way, during the Contest Period.

(ii) Subject to other criteria and conditions stated in the terms of the Contest, the Contest will be open to all residents of India with the exception of employees of MRPL and Britannia, their respective agents, distributors, retailers and any other channel partner, and their immediate family members.

(iii) It is advised and suggested that the Participants must ensure that they are not suffering from any health issues which restrict them from participating in this Contest.

(iv) Participant agrees to share their phone WhatsApp number to MRPL (if not previously shared) for written/ verbal communications from MRPL/ Britannia with regards to the Contest. Participants who do not have a WhatsApp number will not be eligible to participate in the Contest.

(iv) Customers of More Hyper Market stores and online platforms operating at Bangalore, Delhi, Hyderabad, Kolkata, Lucknow shall be eligible for this Contest. The List of More Hyper Market stores for the respective cities are as mentioned herein below:

Contest Period & Contest Timings 

(i) The Contest Period will commence 12:00:01 A.M on 07/04/2023 to 11.59:59 P.M on 06/05/2023 (“Contest Period”).

(ii) Date and Time of participation will be defined as the date/ time at which the entry is received at the system of the agency managing the back end of the Contest i.e. More Retail

(iii) Entries coming outside the Contest Period will not be eligible for the Contest.

(iv) The Prize/s under this Contest are free of cost and the Participants are not required to pay for the same or send any money or share any Bank or Card details with MRPL/Britannia. MRPL/Britannia shall not be responsible if any money is paid, transferred or bank/card related details are shared by the Participant.

(v) The methodology/ process of choosing a Winner in this Contest shall be the sole discretion of MRPL/ Britannia alone and no Participant or any third person shall raise any objection, protest or demur to such coverage or in this regard.

1. How to Participate  
2. The Customer must purchase at least one unit of Britannia Chocolush biscuit 300gm during the aforementioned Contest Period and at the location mentioned in 2 (iv) and/or More App operating in Bangalore, Hyderabad, Kolkata, Delhi and Lucknow.
3.  After making the purchase of Britannia Chocolush biscuit 300gm the Customer needs to share his/her Whatsapp number at the MRPL cash counter/ app so as to participate in this Contest.
4. The Customer will receive a qualitative question on his/her WhatsApp number

b. The Customer must answer a qualitative question which the Customer will receive on his/her registered WhatsApp number.

b. MRPL/ Britannia shall not be responsible for (including but not limited to):

i. Any lost, late, or misdirected computer transmission or network, electronic failures, or any kind of any failure to receive entries owing to transmission failures or due to any technical reason

ii. If the Participant has registered himself to the DND of the telecom provider/ the Participant has registered with National Do Not Call Registry/.

iii. Other conditions beyond the reasonable control of MRPL/ Britannia

MRPL/ Britannia will not be liable under any NDNC (National Do Not Call) Registry / DND regulation or such other regulation that exists or may come into play. Participants agree to receive communications related to the Contest even if they are registered under NDNC, DND (Do Not Disturb), or under any other similar regulation, MRPL/ Britannia or its Agency will have all the authority to call the Participant by virtue of them having voluntarily participated in the Contest. 

1. Prize
2. The Winner will be eligible for only 1 stadium ticket (Ticket) of an upcoming IPL 2023 match. MRPL shall be solely responsible for arranging the Ticket. 
3. No Winner shall have any right to claim a Ticket for any other category of seating or any other match, other than the ones issued by MRPL. 
4. No Winner shall trade/sell/transfer the Ticket, and MRPL/Britannia shall not be held responsible for any such offence/violation.
5. MRPL/Britannia shall not be responsible for issuing fresh Ticket, in case the scheduled IPL match gets postponed or abandoned or for any reason whatsoever does not take place on the scheduled date and venue, and no Winnershall be eligible to claim any refund or issuance of fresh Ticket. 
6. It shall be the sole responsibility of the Winner to reach the match venue on time. The prize shall not cover any extra/ancillary cost like transportation, accommodation, food and such miscellaneous expenses.

1. Winner Selection

A. During the Contest Period, a Participant can participate/ submit any number of entries, however, every Winner shall be eligible for only 1 prize .The Winners will be contacted by MRPL via phone call and WhatsApp message. MRPL/Britannia may publish the names/photographs and such other information/ persona of the Winners, on their social media handles and/or publicize it any medium. In case the Winners are sharing their photographs/ video as requested by MRPL/ Britannia, then it shall be deemed that they   are providing their consent for the same to be used by MRPL/Britannia on their social media pages or any other media.

b. The Participants shall be shortlisted by MRPL based on the answer to the qualitative question sent by the Participant, the entries shall be shortlisted based on the creativity of the answers, thereafter the Winners shall be selected from the shortlisted entries by way of randomizer (hereinafter referred to as, ‘Winner’).  This selection process shall be the sole discretion of MRPL to shortlist the entries. , and the same cannot be challenged under any circumstance. The decision of MRPL shall be final and binding on the Participant in this matter. MRPL/Britannia shall in no case entertain any questions, correspondence, enquiries, etc. on the manner of the selection and the Contest. Further, MRPL/Britannia shall, at all times, have the right to exercise its discretion on the selection of Winners, in order to ensure equity and fairness for all Participants.

1. Publicity

a. The Participant/s undertake and irrevocably and unconditionally permit MRPL/Britannia to cover the Contest through various media including newspapers, radio, television, news channels, internet, point of sale materials, digital media etc., and shall not raise any objection, protest or demur to such coverage or in this regard.

b. Each Participant understands and agrees that their entries/ may be used by MRPL/Britannia for reasonable purposes of this Contest. All the rights including but not limited to the intellectual property rights, copyrights and all other allied, ancillary and subsidiary rights in the entry/ies shall vest with MRPL/Britannia absolutely for perpetuity, throughout the world.

c. MRPL will collect Participant’s personal information such as Legal Name and WhatsApp number of the Participant in order to conduct the Contest. If the information requested is not provided, Participant understands that the Participant would not be eligible to participate in the Contest. By entering the Contest, unless otherwise advised, each Participant also agrees that MRPL/Britannia or its affiliates may use this information, or disclose it to other organizations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Participant. Participants' personal information may be disclosed to government authorities and winners' names may be published.

1. Intellectual Property

a. All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with MRPL/Britannia at all times respectively. MRPL/ Britannia or any person or entity permitted by MRPL/Britannia shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.

b. All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to MRPL/Britannia upon submission and shall become the property of MRPL/Britannia. MRPL/Britannia may use the material in any medium in any reasonable manner it sees fit. Participants agree to give NOC to MRPL/Britannia if required for Copyright registration purposes. 

1. General terms and conditions

(i) Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Contest the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.

(ii) No queries, claims, dispute, complaints or grievances shall be entertained by MRPL/ Britannia after 30 days from the date of the closure of the contest.

 (iii) The prize under this Contest can’t be traded, exchanged, sold, replaced or adjusted with anything including other prize, other gifts or cash.

(iv) Any entry that is abusive or sexually explicit or disrespectful to any community/religion/place/person will be disqualified and such comment will be reported to the relevant authorities and appropriate action shall be taken against such miscreant. No communication in this regards will be entertained. 

(v) MRPL/Britannia reserves the right to change, defer, alter, extend or cancel/terminate this Contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. MRPL/Britannia may also amend the type of Contest, submission mechanism, eligibility criteria, term of the Contest, and the prizes for the Contest; MRPL/Britannia reserves the right to amend, temporarily suspend or withdraw the Contest in its absolute discretion provided that MRPL/Britannia Brand shall not exercise this right unreasonably. All decisions of MRPL/Britannia in respect of the Contest and the prizes therein will be final, binding and conclusive.

(vi) MRPL/Britannia shall not be liable to perform any of its/their respective obligations under the Contest or in respect of the prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances.

(vii)MRPL/Britannia shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions.

(viii)Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of MRPL/ Britannia.

(ix)If a person chooses to access the Contest Website from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.

(x)The participation in the Contest is purely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein.

(xi)The entry, comments of Winners or any other materials sent to MRPL/Britannia including feedback and other communications of any kind shall be deemed to be non-confidential. MRPL/Britannia is free to reproduce, distribute and publicly display such feedback and entries received towards this Contest without limitations or obligation of any kind. MRPL/Britannia is also free to use any ideas, concepts, know-how or techniques contained in such feedback for any purpose. MRPL/Britannia reserves the right to analyse and summarize data that is collected and also reserves the right to publish, distribute, share summaries of the data collected with sponsors or other business partners without limitations or obligations of any kind subject to applicable laws.

(xii)Failure to comply with any of these terms and conditions (including instructions) will disqualify Participant from continuing to take part in the Contest and such Participant's participation will be invalid. MRPL/Britannia retains the sole discretion to refuse Participants the right to participate if it is of the view that these terms and conditions are being violated.

(xiii) MRPL/ Britannia shall not be liable to award/compensate/exchange or in any manner pay or Contest in case  they fail to provide the prize under this Contest due to any cause beyond their reasonable control or foresight, including but not limited to: act of god, insurrection or civil disorder, religious strife, war or military operations, terrorist act, partial or total strikes, either internal or external, lock-out, epidemic, blockage of means of transport or of supplies, national or local emergency, earthquake, fire, storm, flood, water damage, governmental, regulatory or legal restrictions, pandemic/epidemic, area being unserviceable by Premium Courier or Postal Services, Or act or omissions of persons for whom MRPL/ Britannia is not responsible

(xiv)By entering this Contest, Participants agree to hold harmless MRPL/Britannia, its agencies and its affiliates, against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) Participant's participation in the Contest; (ii) the selection criteria or process; (iii) the administration of the Contest; (iv) delivery of the prize for reasons not attributable to MRPL and (v) the quality, warranty, functioning or anything relating to the prize. Participants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including negligence) including but not limited to loss or damage to person or property which the Participant and his/her representatives or assignees may have, suffer or which may hereinafter accrue to the Participant or as a result of the Participant's participation in the Contest or use of the subscription.

MRPL/ Britannia accept no liability, whether jointly or severally, for any errors or omissions, in relation to winning the Contest. The Participant shall be solely responsible for any consequences which may arise from his/her participation in the Contest. Participant also undertakes to indemnify MRPL/ Britannia and its officers, directors, employees and agents on the happening of such any illegal acts committed by the Participant and any third party claim arising therefrom (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by MRPL/ Britannia on account of such act on the part of the Participant. 

(xv)MRPL/Britannia reserves the right to disqualify any Participant who tampers with the entry process or submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of MRPL/Britannia, engaged in conduct in entering or participating in the Contest which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Contest and/or MRPL/ Britannia. 

(xvi)MRPL/Britannia shall not be responsible for late, falsified, delayed, incomplete or destroyed entries and all such entries are void and may be disqualified at any time. MRPL/Britannia does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, lost delayed or garbled data or transmissions, omissions, interruptions, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. Entry materials/ data that have been tampered with or altered are void.

(xvii)All participants acknowledge that the Prize will be taken as offered and cannot be varied. Any unused prizes are not-transferable, non-refundable and non-redeemable for other goods or services and cannot be exchanged for cash or kind.

(xviii) MRPL/ Britannia is not liable for any problems, errors, or negligence that may arise or occur in connection with this Contest, including but not limited to, any damage to the Participant's computer or other technical device, or software, as a result of the Participant's participation in this Contest. MRPL/ Britannia shall not be liable in any way for any failure or breach by any party in connection with this Contest, prize or prizes and accepts no responsibility for any loss suffered by a participant arising from this Contest, prize or prizes.

(xix)The Participants acknowledge that the quality of the prize, and the services of the courier service are not controlled or supervised by MRPL/ Britannia or its Agency, hence any issue with relation to delay in delivery or damage in transit shall have to addressed to the Courier delivery partner and defect in prize or prize related services shall have to addressed to the manufacturer or service provider of the  prize /service alone and MRPL/ Britannia or its Agency shall not be held responsible for it. 

(xx)MRPL/Britannia will collect Participants' information in order to conduct the Contest and subsequently for verification of identity of the Participant. If the information requested is not provided, the Participant would not be eligible to participate in the Contest. By entering the Contest, unless otherwise advised, each Participant also agrees that MRPL/Britannia to carry out the Contest or aspects thereof, MRPL and/or Britannia’s affiliates may use this information, or disclose it to other organizations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Participant. Participants' personal information may be disclosed to government authorities and Winner’s names may be published.

(xxi)The information each Participant provides will additionally be used for the purposes of administering this Contest. All rights are reserved.

(xxii)If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Indian laws shall be exclusively applicable to any and all disputes arising out of or in connection with the Contest or these terms and conditions.

(xxiii)The interpretation and implementation of the Terms and Conditions shall be at the sole discretion of Britannia/ MRPL. The decisions of Britannia / MRPL with respect to aspects of the Contest shall be final and binding, and not subject to challenge or appeal.

(xxiv)These Terms shall be governed by & construed in accordance with the applicable laws in India. Any dispute including any dispute arising out of all matters with respect to this Contest shall be are subject to the relevant jurisdiction of the Courts in India only. All the disputes/complaints/queries, if any, shall be entertained only within one month of the contest getting over and be directed to MRPL @ 8108138000 . Any Winner approaching MRPL/Britannia with any disputes/complaints/queries after the expiry of the aforesaid one month from 06/05/2023  shall not be considered for resolution. Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or MRPL/ Britannia and/or agencies/sponsors associated with this Contest, shall be governed and construed in accordance with the laws of the Republic of India.
